In order to constitute an accord and satisfaction, the money should be offered in satisfaction of the claim, and the offer must be followed with such acts and declarations as amount to a condition that if the money is accepted, it is accepted in satisfaction. Further, the party to whom the offer is made must fully understand that if s/he accepts the offer, s/he takes it subject to such condition. [i]
